On 21 June 2016, Collier J determined by consent the native title rights of the Darumbal People over part of their claim area which includes the Commonwealth training facility at Shoalwater Bay.

The matter had been programmed to proceed by way of trial on connection issues in December 2014, however the trial was vacated in the days immediately beforehand with the Applicant and State reaching agreement on the main issues. The consent determination will take effect upon the registration of two State Indigenous Land Use Agreements dealing with classes of protected areas under the Nature Conservation Act 1992 and the resolution of a number of tenure issues.
