Reminder: Extension to Unfair Contracts Scheme to commence 13 November 2016

You may be aware that the Australian Consumer Law renders unfair terms in standard form consumer contracts void.

Did you know that from 13 November 2016, this protection will extend to contracts with small businesses as well?

A contract will be a small business contract if:

  • at the time that the contract is entered into, one party to the contract employs fewer than 20 persons; and
  • either the upfront price is less than $300,000 or, if the contract is for longer than 12 months, the upfront price is less than $1 million.

If you contract with small businesses and use a standard form contract, you should be reviewing the terms in light of this change.
